Ordinance prohibiting overnight operation set to go into effect

Nov. 17, 2022 – A new Village ordinance prohibiting the operation of service stations and retail goods establishments between midnight and 5 a.m. is set to go into effect following a ruling in the Circuit Court of Cook County on Tuesday, Nov. 15, 2022.

Judge Neil Cohen denied a motion seeking a temporary restraining order filed by service station owners and operators against the enforcement of the Village of Oak Park’s new closing hours ordinance adopted by the President and Board of Trustees on Nov. 7, 2022.

Per the ordinance, it is unlawful for service stations and retail goods establishments within the Village to open earlier than 5:00 a.m., and those businesses must close no later than 12:00 a.m. Several service stations and two 7-Elevens located in the Village were open for business 24 hours and will now be subject to the ordinance. The Village will take steps necessary to notify businesses subject to the new ordinance that enforcement will soon begin.

On Oct. 25, 2022, the Board conducted a public hearing and also made the determination to add retail goods establishments that had been open 24 hours per day to the ordinance, which was initially adopted on Sept 19, 2022. These actions satisfied Judge Cohen’s concerns regarding the original ordinance.

In addition to denying the motion seeking a temporary restraining order on Tuesday, Judge Cohen rescinded a previous temporary restraining order issued on Sept. 30, 2022.
